Two judges of a High Court bench yesterday delivered dissenting orders on a bail petition filed by Fazlul Haque Amini, chairman of a faction of Islami Oikya Jote (IOJ), in connection with a sedition case.
Justice Nozrul Islam Chowdhury, senior judge of the HC bench, asked Amini to surrender before the trial court within four weeks, while Justice Anwarul Haque, the junior judge, summarily rejected the petition.
Amin's counsel Khandker Mahbub Hossain said the HC bench will send the bail petition to the chief justice for a decision.
Upon receiving the bail petition with the dissenting orders, Chief Justice Md Muzammel Hossain will constitute a third bench of the HC for disposal of the matter, he said.
Amini was sued over sedition with a Dhaka court on August 11, for making derogatory remarks about the country's constitution. On July 14, Amini told a meeting in the city's Lalbagh that he will throw the recently amended constitution into dustbin.
Earlier yesterday, Amini appeared before the HC bench, seeking anticipatory bail in the case. He recently filed the bail petition with the HC.
Attorney General Mahbubey Alam opposed the bail petition.
